Agreement for Hire and/or Sale
BY PLACING AN ORDER WITH COSTUMES 2U YOU ARE DEEMED TO HAVE ACCEPTED THE TERMS AND CONDITIONS SET OUT BELOW
1. DEFINITIONS
1.1 'Costumes 2u'
"Costumes 2u" shall mean Costumes 2u Limited (a company registered in England under co. number 05043584) whose registered office is Wellesbourne Road, Barford, Warwick, CV35 8EL, England.
1.2 'Customer'
"Customer" shall mean the individual(s) entering into this Agreement with Costumes 2u.
1.3 'Costume(s)'
"Costume(s)" shall mean the costumes, wigs, props, hangers, packaging, accessories and any other items that are hired or sold by Costumes 2u to the Customer under this Agreement.
2. ENTIRE AGREEMENT
2.1 This Agreement is made between Costumes 2u and the Customer and is effective from the date that the Customer's order is accepted by Costumes 2u.
2.2 These terms and conditions, the advertised prices of the Costumes and the order constitute the entire agreement between Costumes 2u and the Customer.
2.3 No variation of these terms and conditions is effective unless confirmed in writing by an authorised employee of Costumes 2u.
2.4 Costumes 2u reserves the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website or otherwise and howsoever brought to the attention of the Customer notwithstanding that the Customer may be familiar with a version of the terms and conditions through a course of dealings with Costumes 2u.
3. ORDERS AND ACKNOWLEDGMENT
3.1 An order for the hire or purchase of a Costume or Costumes may be placed by telephone or using the Costumes 2u online ordering facility.
3.2 The price of the hire or sale of the Costume(s) shall be Costumes 2u's quoted price. All prices are quoted in Sterling and include VAT. VAT receipts are available on request. Once an order has been accepted by Costumes 2u, an e-mail confirmation will be sent to the Customer (where a valid e-mail address is provided).
3.3 Costumes 2u makes every effort to ensure that the descriptions and content on its website are current. However, Costumes 2u does not give any warranty as to the accuracy of any such information. The Costumes and prices listed on the website or any other medium, constitute an invitation to treat.
3.4 Where a Costume is not available or becomes unavailable following acceptance of an order, the Customer will be advised as soon as reasonably possible and offered an alternative Costume or a refund for the value of the amount paid in respect of the Costume not available.
3.5 This Agreement shall govern the relationship between Costumes 2u and the Customer to the exclusion of any other terms and conditions subject to which any order is made or purported to be made by the Customer.
4. PAYMENT
4.1 Payment in full is required to secure an order. Payment by credit card for orders over £1000 will attract a 2% surcharge
4.2 Fifty per cent of the payment will be held as a non-refundable booking deposit.
4.3 An additional security deposit (the "Security Deposit") against potential late return, damage or loss to Costumes that are hired to the Customer is required at prevailing rates. This will be returned to the Customer on return of the Costume(s) on the due date, subject to compliance by the Customer with the terms of this Agreement.
5. DELIVERY AND COLLECTION
5.1 Costumes 2u will deliver the Costume(s) to the Customer to the address nominated by the Customer up to two days before the date of the event notified to Costumes 2u by the Customer. For the avoidance of doubt time shall not be of the essence of this Agreement.
5.2 Costumes 2u shall not be liable for a failure to deliver Costumes or any delay in doing so or for any damage or defect to Costumes delivered that is caused by any event or events beyond Costumes 2u's control, including but not limited to, an act of God, hostilities, terrorism, industrial strikes, lock-out or other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
5.3 Costumes 2u will collect the Costume(s) from the Customer up to five days after the date of the event from the address notified to Costumes 2u by the Customer.
5.4 Failure to have the Costume(s) ready for collection at the agreed time constitutes 'late return' and will result in one additional rental charge per night thereafter until the Costume is returned. Costumes 2u reserves the right to charge reasonable travelling expenses for any return visit(s) required to collect.
5.5 For Warwick Castle orders delivery and collection are free of charge from a Hotel or BB delivery and/or collection point within a [ 3 ] mile radius of Warwick Castle for orders over [£60] . Any delivery and/or collection from a point outside a [ 3 ] mile radius will be charged at [ 2 ] pound per mile for mileage in excess of [ 10 ] miles for the total return journey, subject to the managements discretion.
5.6 For Coombe Abbey orders delivery and collection are free of charge to the Coombe Abbey Hotel for orders over £150. Orders below this value will attrack a delivery premium at prevailing rates, please contact management for details
6. DISTANCE SELLING REGULATIONS
Under the Consumer Protection (Distance Selling) Regulations 2000 the Customer has the right to cancel the order provided notice of cancellation is given to Costumes 2u within 7 working days and the Customer acts in accordance with these terms and conditions, provided that Costumes 2u has not commenced providing the services to be supplied under this Agreement, in which event this right shall lapse.
Cancellation must be notified in writing and is only effective when Costumes 2u confirm it to the Customer in writing. The Customer does not need to state the reason for cancellation nor will there be any penalty payable. Once Costumes 2u have accepted the Customer's cancellation, any payment received will be refunded within 30 days.
7. TITLE
7.1 All Costumes supplied by way of hire to Customers under this Agreement remain the sole and absolute property of Costumes 2u at all times during the Agreement.
7.2 For the avoidance of doubt and notwithstanding anything else in this Agreement, all Costumes sold to Customers under this Agreement shall remain the sole and absolute property of Costumes 2u until payment has been received in full.
8. DAMAGE AND LOSS CHARGES FOR HIRED COSTUMES
8.1 Any damage, whether accidental or otherwise, to any part of a hired Costume(s) will forfeit in full the Security Deposit.
8.2 Where damage is considered by Costumes 2u to be extensive, that part of the cost of replacing the Costume which exceeds the amount of the Security Deposit shall be payable by the Customer to Costumes 2u.
8.3 The Customer shall be liable for the cost of replacing the Costume in the event of failure to return the Costume within 7 days of the final possible date for collection.
8.4 Replacement charges for Costumes shall be charged at between £50 and £300 depending on the Costume in question. Replacement charges for Costumes consisting of props and/or accessories shall be at the prevailing purchase prices in our online Shop.
9. LIABILITY
9.1 All statutory or other warranties, conditions, descriptions or representations, express or implied, as to the state, quality or fitness of the Costumes, the subject of this Agreement are expressly excluded to the extent that it is reasonable in all the circumstances to do so. Costumes 2u shall not be liable for any indirect or consequential loss of any kind in contract, tort or otherwise arising. Costumes 2u shall only be liable for direct losses caused by Costumes 2u (except for liability for death or personal injury caused by Costumes 2u's negligence) up to a maximum of the price of the Costume(s) giving rise to the claim. The statutory rights of the Customer for the purposes of the Consumer Transactions (Restrictions on Statements) Order 1976 are not affected.
9.2 Any waiver or amendment of any provision of this Agreement shall be effective only if made by an express written Agreement between parties.
9.3 No waiver by Costumes 2u of any breach of these terms and conditions by the Customer shall be treated as a waiver of any subsequent breach of the same or any other provisions.
10. DATA PROTECTION
Costumes 2u reserves the right to make a nominal charge if the Customer requests access to its contact details held on Costumes 2u's database more than once in any 12 month period. This does not affect your rights under the Data Protection Act 1998.
11. APPLICABLE LAW
This Agreement shall be governed by, and construed in accordance with, English Law and subject to the exclusive jurisdiction of the English courts.

Shipping And Handling
Orders will be sent by recorded delivery and will be processed within 1-3 days.

Delivery Schedule
We will normally send your order the same day if ordered before 11am or the next business day after that. If you require your order urgently then please contact us to discuss alternative delivery options.

We undertake to complete all reasonable actions to ensure our products meet with your satisfaction. Fancy Dress Costume Material is Highly Flammable and should be kept away from heat sources and naked flames.
